The site pogo-collection.com, mindful of individuals' rights, in particular with regard to automated processing, and in a spirit of transparency towards its users, has established a policy covering all such processing, the purposes pursued by it, and the means of action available to individuals so that they can best exercise their rights. The User's connection to and browsing of the Site imply full and unreserved acceptance of this legal information. You accept the use of cookies and other trackers as clearly stated in the "Cookie Policy" section.

ARTICLE 1 – Legal information

ARTICLE 1.1 – Site (hereinafter the "Site")

ARTICLE 1.2 – The User (hereinafter the "User")

Any person intended to benefit from the Site's services, whether registered or not.

ARTICLE 1.3 – The Publisher (hereinafter the "Publisher")

The publication and editorial management of the Site are handled by a volunteer, non-professional team, which can be contacted at the following address: [email protected].

ARTICLE 1.4 – The Host (hereinafter the "Host")

The Site is hosted by HostMyServer (SARL), whose registered office is located at 71 rue Francis de Pressensé, 69100 Villeurbanne, France. Telephone: +33 7 80 90 52 87.

ARTICLE 2 – Access to the Site

To ensure its proper management, the Publisher may at any time:

  • suspend, interrupt or limit access to all or part of the Site;
  • restrict access to the Site, or to certain parts of the Site, to a specific category of users;
  • remove or modify any information likely to disrupt its operation;
  • temporarily suspend the Site, even without prior notice, in order to carry out updates;
  • permanently shut down the Site, with prior notice given only to registered users who provided a valid email address upon registration.

The User undertakes not to use the Site and the information it contains for commercial, political or advertising purposes, or for any form of commercial solicitation, in particular the sending of unsolicited emails.

ARTICLE 3 – Liability

The Site is accessible everywhere, 7 days a week and 24 hours a day, except in the event of force majeure, scheduled or unscheduled interruption, or maintenance requirements. In the event of modification, interruption or suspension of the Site, the Publisher cannot be held liable.

The User's connection equipment is their own responsibility. The User must take all appropriate measures to protect their equipment and data, in particular against virus attacks.

The Publisher cannot be held liable, in the event of legal proceedings against the User:

  • as a result of the use of the Site or of any service accessible via the Internet;
  • as a result of the failure to comply with this legal information or the Terms of Use.

The Publisher is not liable for damage caused to the User, to their equipment or to third parties as a result of their connection to or use of the Site. If the Publisher becomes subject to amicable or legal proceedings related to the User's use of the Site, it may seek recourse against the User to obtain compensation for the losses, sums or costs incurred.

ARTICLE 4 – Site content and intellectual property

Trademarks, logos and signs, as well as all the content of the Site (text, images, sounds, etc.), are protected under the French Intellectual Property Code.

The Pokémon images, the Stickers, the Backgrounds and the Pokémon GO brand belong to Niantic, publisher of the game Pokémon GO. Pokémon names belong to The Pokémon Company. Niantic and The Pokémon Company have no connection with the Site.

The collection management system, the Stickers, the Backgrounds and all other features of the Site are protected by the French Intellectual Property Code and belong to pogo-collection.com.

Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, without the prior written agreement of the Publisher, is strictly prohibited.

ARTICLE 5 – Hyperlinks

The User may set up hyperlinks to all or part of the Site. Any link must be removed upon simple request by the Publisher.

Any information accessible via a link to other sites is not published by the Publisher, who has no control over such content and therefore assumes no responsibility for it.

ARTICLE 6 – Data collection and retention period

The Site ensures that the User's personal data is collected and processed in compliance with the French Data Protection Act No. 78-17 of 6 January 1978.

The data collected is:

  • The User's email address, mandatory for registration and kept for as long as the account is active;
  • Cookies necessary for the operation of the Site, encrypted and anonymous, placed on the User's device for a maximum period of 30 days. They are mandatory;
  • Configuration cookies (language and theme) placed without an expiry date but which the User can delete manually.

Action logging (creation, deletion, update) may record:

  • the name of the registered User,
  • the IP address,
  • the actions performed.

This data is automatically deleted 30 days after its creation.

ARTICLE 7 – Right of access, rectification and deletion

In accordance with the Act of 6 January 1978, the User has a right of access, rectification, deletion and objection regarding their personal data. This right may be exercised by email to: [email protected]. Before any processing, the Publisher may request proof of identity.

In the event of non-compliance with the processing of your data, you may lodge a complaint with the CNIL (French data protection authority), 3 Place de Fontenoy, TSA 80715, 75334 PARIS Cedex 07, France.

ARTICLE 8 – Deletion of inactive accounts

In accordance with the CNIL's recommendations, an account is considered inactive when the User no longer signs in for a period of two years. At the end of this period, the account is permanently deleted, with no possibility of recovery. The User must therefore sign in at least once every two years. The Publisher may or may not send a reminder before deletion.

ARTICLE 9 – Sharing of personal data

No data will be sold or transferred to a third party. The data is used only in connection with the operation of the Site and may be handled manually by the Publisher only in the event that the User loses access to their account (excluding cookies, which are stored locally).

ARTICLE 10 – Advertising

The Site displays no advertising and is entirely free. No third-party tracker is used. Only the necessary cookies, described in this policy, are placed.

ARTICLE 11 – Cookie policy and local storage

Article 11.1 – Preamble

The Site uses cookies and similar technologies to provide and improve the service. By browsing the Site, the User accepts the placing of cookies necessary for its operation.

Article 11.2 – What is a cookie?

A cookie is a small file stored on the User's device and associated with a web domain. This file is automatically sent back during subsequent contacts with that domain.
