TERMS OF USE

This is a courtesy translation of the French Terms of Use. In the event of any discrepancy or dispute, the French version prevails.

These Terms of Use (the "Terms") are intended to set the legal framework for the ways in which the site pogo-collection.com and its services are made available, as well as the conditions under which users may access and use them.

ARTICLE 1 – Legal information

In accordance with articles 6-III and 19 of French Law No. 2004-575 of 21 June 2004 on Confidence in the Digital Economy (L.C.E.N.), the following legal information is brought to the attention of users.

ARTICLE 1.1 – Site (hereinafter the "Site")

PoGo-Collection.com, commonly referred to as PGC.

ARTICLE 1.2 – The User (hereinafter the "User")

Any person intended to benefit from the Site's services, whether registered or not.

ARTICLE 1.3 – The Publisher (hereinafter the "Publisher")

The publication and editorial management of the Site are handled by a volunteer, non-professional team, which can be reached at the following address: [email protected].

ARTICLE 1.4 – The Host (hereinafter the "Host")

The Site is hosted by Hostmyserver (SARL), located at 71 rue Francis de Pressensé, 69100 Villeurbanne, France, telephone: +33 7 80 90 52 87.


ARTICLE 2 – User's obligations

Any use of or registration on the Site implies full and unreserved acceptance of these Terms, as well as of the Privacy Policy (which includes the legal information and the cookie policy), accessible upon registration and in the footer.

If the User does not accept the Terms or the Privacy Policy, they must refrain from accessing the Site's services.

The Site reserves the right to modify the content of these Terms unilaterally and at any time.


ARTICLE 3 – Description of the Site

The Site notably offers registered Users the ability to:

  • Manage collections related to the game Pokémon GO, published by Niantic;
  • Complete their collections through access to a Pokémon shop (once available).

ARTICLE 4 – Access to the Site

Services available with or without registration

  • Collecting Pokémon, Stickers, Backgrounds, Gym Badges or any other type of collection (data stored locally on the User's device, not persistent across devices);
  • Viewing a friends list (without being able to contribute to it).

Services available only after registration

  • Adding one's account to a friends list accessible on the Site;
  • Collecting Pokémon, Stickers, Backgrounds, Gym Badges or other collections (stored on the Site's server, persistent across devices);
  • Linking one's account to Discord, GitHub or Google to sign in through those platforms;
  • Accessing the shop (once available);
  • Obtaining early access to certain features (defined later through announcements).

The Site is available free of charge to any User with an Internet connection. All associated costs (hardware, connection, software, etc.) remain the User's responsibility.


ARTICLE 5 – Registration procedure

An unregistered User does not have access to certain services, in particular server-side storage.

When registering, the User undertakes to provide accurate information, in particular a valid email address. Access to the Site is only possible after explicit verification of the email address via the link sent.

To access reserved services, the User must then sign in using their identifier (username or email) and their password.

Any registered User may request the deletion of their account by contacting the Publisher at the address mentioned in ARTICLE 1.3. Deletion will be carried out within a reasonable time.

User's commitments

The User (registered or not) undertakes to:

  • keep their credentials confidential (if registered);
  • use the Site in accordance with its intended purpose;
  • not harm the proper functioning of the Site;
  • not exploit potential vulnerabilities. These must be reported on a strictly confidential basis to the Publisher (only) at the email address indicated in ARTICLE 1;
  • limit themselves to the services defined in ARTICLE 4.

In the event of force majeure resulting in a malfunction of the Site or the server, or in the event of maintenance, the Site cannot be held liable. In such situations, the User agrees not to hold the Publisher responsible for any interruption, even without notice.

ARTICLE 6 – Data collection

The Site ensures that personal data is collected and processed in compliance with French Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties.

In accordance with this law, the User has a right of access, rectification, objection and deletion regarding their personal data. These rights may be exercised by email to the Publisher (address mentioned in ARTICLE 1).

The User is informed that cookies may be placed on their browser during their visit. Browsing the Site implies acceptance of them.

ARTICLE 7 – Intellectual property

Trademarks, logos and signs, as well as all the content of the Site (text, images, sounds, etc.), are protected by the French Intellectual Property Code.

The Pokémon images, the Stickers, the Backgrounds and the Pokémon GO brand belong to Niantic, publisher of the game Pokémon GO. Pokémon names belong to The Pokémon Company. Niantic and The Pokémon Company have no connection with the Site.

The collection management system, the Stickers, the Backgrounds and all other original features are protected and belong to pogo-collection.com.

Any reproduction, representation or adaptation, in whole or in part, without the written agreement of the Publisher, is strictly prohibited.


ARTICLE 8 – Liability

The information on the Site is deemed reliable, but the Site does not guarantee that it is free of errors or omissions.

The information is provided for guidance only and has no contractual value. The Site cannot be held liable for:

  • legislative or administrative changes made after publication;
  • the use or interpretation of the information on the Site;
  • any viruses that may infect the User's equipment;
  • damage resulting from an event of force majeure;
  • the content of external sites accessible via hyperlinks.

ARTICLE 9 – Applicable law and competent jurisdiction

These Terms are governed by French law.

In the event of a dispute, an attempt at an amicable resolution will be sought. Failing an agreement, the dispute will be submitted to the competent French courts.
